                                                               AGENDA REPORT

DATE:                                          May 13, 2024

TO:                                          City Commission

FROM:                                          Bill McDaniel, City Manager

SUBJECT:                     Resolution Accepting Encroachment Easement Agreement

                     (1812 North Barnes Street).

EXECUTIVE SUMMARY:

A portion of an existing residential building located at 1812 North Barnes Street encroaches into the public right-of-way, being an encroachment of 3.1 feet to 1.4 feet on the North side of the building as described in the associated survey. The residence was built around 1946, and the owner David Fox is currently under contract to sell the property.

Mr. Fox has requested the City for documentation authorizing this encroachment. The City Attorney has prepared an Encroachment Easement Agreement, which would allow the building to remain as-is on the portion of the right-of-way where it is currently encroaching. The easement would terminate if the building was removed.

RECOMMENDATION:

That the City Commission approve the form of the Encroachment Easement Agreement, and authorize the City Manager to execute the agreement on behalf of the City.

FISCAL IMPACT:

None.
