SUBJECT: Legislative public hearing on an ordinance for a text amendment to Division 4, Article VII, Chapter 102, for Sidewalk Cafes. (PB-2024-21)
EXECUTIVE SUMMARY
This publicly initiated text amendment is proposed to amend current procedures regarding Sidewalk Café’s.
The text below summarizes the major revisions:
• Adds language regarding a $50 review fee.
• Amends language regarding distance requirements from sidewalk café enclosures to the edge of sidewalk and other items within the right of way to enforce ADA requirements of the Florida Building Code.
• Amends language to limit the allowed enclosure materials to be reflective of certain materials allowed within the Historic Districts of the City including wrought iron or wood or materials that look like wrought iron or wood.
• Amends language to limit the size of the enclosure to only be the necessary size to accommodate outdoor seating.
• Establishes a renewal requirement for January 1st of each year.
On April 24, 2024, the Planning Board voted (7-0) finding the text amendment consistent with Chapter 102, Plant City Code of Ordinances and the Imagine 2040: Plant City Comprehensive Plan and to forward the request to the City Commission with a recommendation of approval.
RECOMMENDATION
That the City Commission adopt an ordinance to amend sections of Division 4, Article VII, Chapter 102 for Sidewalk Cafés.
FISCAL IMPACT
Although minimal, the review fee will be deposited in the General Fund.
