                                                               AGENDA REPORT

DATE:                                          August 26, 2024

TO:                                          City Commission

FROM:                                          Bill McDaniel, City Manager

SUBJECT:                     Utility Work and Design By Highway Contractor Agreement with Florida Department of Transportation for I-4 Truck Parking Facility (FPID 448698-1-52-01).

EXECUTIVE SUMMARY:

The Florida Department of Transportation (FDOT) acquired a parcel South of I-4 and West of County Line Road (Folio # 090397-0200) for their future truck parking facility project. On September 13, 2021, the City Commission approved the subordination agreement with the FDOT. With this agreement, the City shall continue to have all rights under the easement, except that the use of the real property shall be subject to the control of the FDOT. In the event that the City’s existing utilities conflict with the FDOT’s use, FDOT shall fully compensate the City for all quantifiable expenses related to the relocation, protection, adjustment, and/or removal of the City’s facilities.

During the conceptual design review of the I-4 truck parking facility, the Utilities Department identified the potential conflicts between the City’s water and sewer mains and the proposed retention ponds in the I-4 truck parking facility.

FDOT’s design-build firm requires a Utility Work by Highway Contractor Agreement (UWHCA) to provide services for adjustment and relocation of the City's utilities. Upon review of the terms and conditions in the UWHCA, staff recommends approval of the agreement with FDOT to adjust and relocate the existing utilities.

RECOMMENDATION:

That the City Commission authorize the City Manager to execute the UWHCA with FDOT for I-4 Truck Parking Facility (FPID 448698-1-52-01).

FISCAL IMPACT:

There is no fiscal impact, since FDOT shall be responsible for all costs of the utility work including adjustments or changes required to construct the I-4 Truck Parking Facility.
