SUBJECT: Modification of agreement with Badger Meter, Inc.
EXECUTIVE SUMMARY:
On September 11, 2023, the City Commission adopted Resolution 185-2023, which authorized the City Manager to approve future price adjustments that were in the best interest of the City. However, Amendment 3 includes additional changes for consideration by the City Commission. The adjustments include:
• A price increase of 2.36%,
• A new section titled "Public Records" to clarify the standard language,
• Changes to section 4 "Prices," outlining the process for price adjustments, and
• Changes to section 7 "Termination" regarding agreement on price increases.
These changes are included in the attached amendment.
RECOMMENDATION:
That the City Commission adopt a resolution approving Amendment 3 to the contract with Badger Meter, Inc. and authorize the City Manager to approve future price adjustments that are in the best interest of the City based on the terms and conditions outlined in the agreement.
FISCAL IMPACT:
Funds are available in the Water/Sewer Fund, CIP # UM006 - Water Meters.
