SUBJECT: Drainage Easement for Sydney Road Culvert Rehabilitation (Upstream)
EXECUTIVE SUMMARY:
The City evaluated an existing culvert/stormwater structure near 1502 Sydney Road and determined the necessary repairs and improvements. The upstream end of the stormwater structure falls within the property owned by the Walden Lake Community Association, Inc. To make permanent modifications to this structure, the City must illustrate to the Southwest Florida Water Management District (SWFMWD) that the City has legal authority to access and conduct maintenance on the structure in the form of a Drainage Easement. Without an easement, the City will not be able to acquire a permit from SWFWMD to make the improvements.
RECOMMENDATION:
That the City Commission adopt a resolution accepting a drainage easement from the Walden Lake Community Association, Inc. for maintenance access to the upstream end of the Sydney Rd culvert/stormwater structure and authorize the City Clerk to record the easement on behalf of the City.
FISCAL IMPACT:
No fiscal impact.
