FROM:                                          Bill McDaniel, City Manager

SUBJECT:                     Resolution approving real estate purchase agreement with Carl L. Carpenter, Jr. and Marilyn S. Carpenter as Trustees and Individually.

EXECUTIVE SUMMARY:

At the direction of the City Commission, the City Manager and the City Attorney have negotiated a real estate purchase agreement with Carl L. Carpenter, Jr. and Marilyn S. Carpenter, as trustees and individually ("Seller"). The Seller has agreed to terms and the City is currently waiting on the Seller's execution of the agreement.

The agreement provides that the City shall name the property after the Seller, such as Carpenter’s Legacy Preserve.

The subject property is intended for activities related to natural space preservation, stormwater management, cultural, historical, environmental, and agricultural programming, and similar recreational and parks activities that will benefit the Plant City community for generations to come.

RECOMMENDATION:

It is recommended that the City Commission approve the real estate purchase agreement; authorize the City Manager to execute the agreement on behalf of the City, and to the authorize the City Manager and/or the City Attorney to execute any further documents necessary to effectuate the purchase.

FISCAL IMPACT:

The purchase price is $3,500,000, plus closing costs. The costs of title insurance and documentary stamps is $11,325.00 and $24,501.50 respectively. Additional costs would be for a survey, Phase I Environmental Assessment, and Seller’s legal fees not to exceed $2,500. The purchase price and expenses are budgeted (PK044).
