DATE:                                          January 12, 2026

TO:                                          City Commission

FROM:                                          Bill McDaniel, City Manager

SUBJECT:                     Environmental Protection Commission Requirements

EXECUTIVE SUMMARY:

On December 4, 2025, the Environmental Protection Commission (EPC) notified the City that they were beginning enforcement penalties for two above ground storage tanks located at the Fleet Department.  While the source of these fines predated acquisition of the property in 2002, the City must accept responsibility for maintaining the required licenses and safety equipment.

The City Attorney’s Office negotiated a significantly lower fine of $4,687.50, which is one fourth of the original fine proposed by EPC.

All licensing, safety equipment, and monitoring are up-to-date with no standing violations left to clear.

RECOMMENDATION:

That the City Commission accept the EPC fine of $4,687.50.

FISCAL IMPACT:

Funds are available in the General Fund, Org # 00155102, Obj # 434000 - Fleet Maintenance Other Contractual Services.
