SUBJECT:                     Resolution setting a quasi-judicial public hearing on an ordinance to modify the Parkside Planned Development District located on the south side of West Grant Street at South Tyler Street (PB-2025-04).

EXECUTIVE SUMMARY:

The applicant proposes modifications to the Parkside Planned Development District to amend conditions which allow temporary access onto Mendonsa Road.

The Parkside Planned Development District was approved by the City Commission on November 22, 2021. A condition of approval was to prohibit all access to Mendonsa Road.  The site was designed, permitted, and platted in compliance with this restriction.  The development contains one access on Grant Street.

Construction on the City’s Lift Station #7 began in May 2024 and unforeseen field challenges have impacted construction access to the townhome project. The developer has completed infrastructure improvements and is ready to move forward with home building, but this progress is impacted by the extended closure of access from Grant Street.

On November 12, 2024 the City Commission approved the request for temporary construction access with the following condition:

*Temporary construction access shall be allowed on Mendonsa Rd when the Grant St access is closed due to Lift Station #7 construction or other Grant St construction activity and only for the duration of such closure(s). The temporary Mendonsa Rd access will remain dosed at all other times. Once the Grant St access is permanently reopened, the temporary Mendonsa Rd access shall be permanently closed and removed. Furthermore, construction access at Mendonsa Road shall be limited to the hours of 7:00 a.m. to 6:00 p.m. Monday through Saturday, and shall be prohibited on Sundays and the following holidays: Thanksgiving {11/28/24), Christmas Day (12/25/24}, New Year's Eve (12/31/24), New Years Day (1/1/25}, Martin Luther King Jr Birthday (1/15/25), and Parade Day {March 3, 2025). Owner/Developer shalt further direct all suppliers, contractors, construction workers, and other vendors accessing the property that all access to and from Mendonsa Road shall be only through Alexander Street, and not Hunter Street. Owner/Developer shall place a "No left turn" or "Right turn only" sign at the temporary construction access at Mendonsa Road for traffic exiting the project. In the event the Grant St access is not permanently open by May 12, 2025, the temporary construction access on Mendonsa shall terminate on May 12, 2025. If an extension is needed for the May 12, 2025 deadline, Owner/Developer shall apply for said extension as a major modification of the Planned Development District.

Recently the City announced that the completion date of the project has been extended as far as December of 2025 which lies outside of the current expiration date of the temporary access (May 12, 2025). Further, the specific holidays mentioned in the current condition have all passed. Since the roadwork has been extended through December of this year, the condition has been modified as follows to also allow normal/sales office traffic as well.

*Temporary access shall be allowed on Mendonsa Rd when the Grant St access is closed due to Lift Station #7 construction or other Grant St construction activity and only for the duration of such closure(s). The temporary Mendonsa Rd access will remain closed at all other times. Once the Grant St access is permanently reopened, the temporary Mendonsa Rd access shall be permanently closed and removed.  Owner/Developer shall further direct all suppliers, contractors, construction workers, and other vendors accessing the property that all access to and from Mendonsa Road shall be only through Alexander Street, and not Hunter Street. Owner/Developer shall place a “No left turn” or “Right turn only” sign at the temporary access at Mendonsa Road for traffic exiting the project.

On March 26, 2025 the Planning Board voted 7-0 to forward the request to the City Commission with a recommendation of approval.
