SUBJECT:                     Legislative public hearing to vacate a 1.65 +/- acre public utility easement generally located at 3340 Henderson Way within the Lakeside Station Planned Development District. (PB-2025-21).

EXECUTIVE SUMMARY:

The applicant is requesting to vacate a 1.65 +/- acre public utility easement generally located at 3340 Henderson Way within the Lakeside Station Planned Development district. All utilities located within the subject easement were relocated to the adjacent Henderson Way ROW. This easement was initially acquired for the purpose of constructing Henderson Way; however, the roadway's location has since shifted. Therefore, the easement is no longer needed.

On September 17, 2025, staff presented a recommendation of approval for the proposed vacate to the Planning Board, based on the positives, negatives and mitigating factors presented in the attached staff report for PB-2025-21.  The Planning Board subsequently voted (6-0) to recommend approval of this proposal to the City Commission.

RECOMMENDATION:

That the City Commission adopt an ordinance approving the request to vacate a public utility easement for the property generally located at 3340 Henderson Way within the Lakeside Station Planned Development District (PB-2025-21).
